Liability and Indemnity

General liabilities applied are:

• No claims against the other party in respect of property loss or consequential loss relating to performance under an agreement with the exception of wilful misconduct (capped at £100M, index linked).
• No claims can be made against Vesterled relating to their activities at the St Fergus Gas Terminal and correspondingly TOTAL will procure that no claim is made by Vesterled against the FUKA service users
• Each party indemnifies and holds harmless the other party in respect of injury or death of employees in connection with any agreement.

There is also a liability regime during completion of tie-in work (i.e. new shipper indemnifies TOTAL E&P UK Limited).
